All of the warranties represented here are for Harvey products manufactured after March 1, 2005. For older vintage items manufactured prior to March 1, 2005, please contact our Field Service Department at 1-800-822-0437 or visit our customer service page.


LIFETIME LIMITED TRANSFERABLE WARRANTY

The extruded, solid vinyl members, screening and component mechanical parts, including locks, keepers, balances, and sash retainers are warranted against defects in material and workmanship for as long as the original purchaser owns and resides in the house in which they are installed.

TWENTY YEAR WARRANTY

Insulating glass is warranted against material obstruction of transparency resulting from film formation or dust collection on the interior surfaces for a period of twenty years.

TRANSFERABILITY

In the event the original purchaser sells the property in which the vinyl windows are installed, the coverage provided by this warranty will be limited to only the next subsequent owner and will be twenty (20) years from the date of manufacture.

EXCLUSIONS AND LIMITATIONS

The above warranty periods commence on the date of shipment from the manufacturing facility.

This warranty does not cover broken glass; torn screening; damages resulting from improper installation; damages caused by airborne pollutants such as salt or acid rain; negligence or unreasonable use (including failure to provide reasonable and necessary maintenance); stress resulting from localized application of heat that causes excessive temperature differential over the glass surface or the edges of the unit; damage resulting from fire, lightning, windstorms, earthquakes, windborne objects, strain applied to the unit by movement of the building or inadequate provision for expansion or contraction of framing members; condensation on windows, which is a natural result of humidity within the house and the difference between the internal and exterior temperatures; installation in ships, vehicles, or outside the continental United States; seal failure if the seal has been subject to immersion in water; acts of God or other causes beyond the control of the manufacturer.

Locking or non-locking screens will not stop a child from falling out a window. Screens are not intended to act as a human barrier.

This warranty covers only manufacturing defects, is limited to repairing or replacing defective parts or components, and providing return transportation to the manufacturer’s nearest place of business, and does not include labor or other costs incurred in the removal, replacement, installation, or reinstallation of the product or any part or component of the product. Harvey Building Products reserves the right to discontinue or modify any of its products without notice and will not be liable under this limited warranty as a result of such discontinuance or modification and will have the right to substitute products which, in its sole discretion, are of equal value and quality. This warranty is intended to cover individual homeowners and does not apply to products purchased by or installed in commercial applications such as property owned by corporations, governmental agencies, partnerships, trusts, religious organizations, schools, or cooperative housing arrangements, or installed on apartment buildings or any other type of buildings or premises not used by individual homeowners as their residence. For such purchasers or entities to which this coverage does not apply, the warranty period will be (10) years following the date of original installation.

This warranty applies to the following Harvey vinyl window products only: double hung, single hung, casement, awning, hopper, rolling, picture and designer shapes. Bay and bow configurations are also covered; however wood components are limited to a 10 year warranty. Acoustic vinyl windows are limited to a 10 year non-transferable warranty. This warranty does NOT apply to garden windows.

The statements contained herein set forth the only express warranties of the above products. Any implied warranties imposed by law, such as implied warranties of merchantability or fitness for a particular purpose, are limited in time to the duration of the above express warranties.

The manufacturer shall not be liable to the buyer for incidental or consequential damages for breach of any written or implied warranty.

Some states do not allow limitations on how long an implied warranty lasts, and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state.

CLAIMS PROCEDURE

The product should first be inspected by the company that sold and installed the product to the homeowner within a reasonable time after discovery of a problem to determine if the problem is installation or product related. To make a claim under this warranty for a product defect, either the contracting company or the homeowner should notify Harvey Building Products by calling our Field Service Dept at 1-800-822-0437, visiting our website at harveybp.com, or sending an email to fieldservice@harveybp.com. The claim must identify the company that the product was purchased from, the window type, installation date, serial number and the specific defect.

TWENTY YEAR WARRANTY

Insulating glass is warranted against material obstruction of transparency resulting from film formation or dust collection on the interior surfaces for a period of twenty years according to the following formula: years 0-10=100% years 11-15=50% years 16-20=25%.

TEN YEAR WARRANTY

Aluminum and wood structural members are warranted against defects in material and workmanship for a period of ten years. Aluminum members that have a baked enamel finish are warranted against blistering, peeling, flaking, or checking under conditions of normal wear and service for a period of ten years. The extruded, interior vinyl members are warranted against defects in material and workmanship for a period of ten years. All exposed wood must be properly sealed within 48 hours upon installation. Harvey will not be responsible for water staining, discoloration, etc. resulting from condensation or moisture that takes place before units are finished on the interior. Prolonged exposure to condensation and/or humidity may discolor or stain wood members even after the finish has been applied. Again, Harvey is not responsible for damages of this nature. Harvey does not recommend that you paint the aluminum-clad units, nor do we warrant any finish applied over the exterior clad coating.

EXCLUSIONS AND LIMITATIONS

Your FlexScreen carries a limited lifetime warranty for any defects that arise that would prevent the product from effectively deterring the entry of insects into your home. This limited warranty is valid only for the original consumer purchaser (“the Consumer”) and is not transferable to any subsequent purchaser. No limited warranty service is available without registering your FlexScreen within 30 days of retail purchase.

FlexScreen, LLC (“Warrantor”) will repair or replace, at its option, this product during the limited warranty period, subject to the exclusions and limitations set forth herein. Any replacement will be made with a new product. If the product is no longer available, replacement may be made with a similar product of equal or greater value. This is your exclusive limited warranty.

Should any failure covered by this limited warranty occur, the Consumer must provide proof of the failure to Warrantor. This may require the Consumer to deliver or ship the product to FlexScreen, LLC. All freight, packaging and transportation charges, including costs associated with any shipment of the product to Warrantor and any shipment of the repaired or replacement product back to the Consumer, will be borne by the Consumer, in order to be eligible for repair or replacement under this warranty, you MUST return the warranty registration card within 30 days of purchasing your FlexScreen. Keep the original sales receipt. Proof of purchase is required to obtain warranty performance. Retailers do not have the right to alter, modify, or any way change the terms and conditions of this limited warranty.

WARRANTOR SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE IS LIMITED IN DURATION TO THE DURATION OF THE ABOVE LIMITED WARRANTY. THERE ARE NO EXPRESS WARRANTIES OTHER THAN THOSE SET FORTH HEREIN. SOME STATES, PROVINCES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

TEN YEAR WARRANTY

The Harvey garden window product is warranted to be free from defects in material and workmanship under normal use and maintenance for a period of ten years from the date of original installation. A new or repaired window or part, at Harvey’s sole option, to replace any window or part determined by HARVEY to be defective, will be provided at no charge, PROVIDED that the warranty claim is made following the claim procedure below.

This warranty applies only to garden window products in their original installation location and becomes void upon reinstallation. Any replacement windows or parts are warranted only for the remaining time period of the original warranty.

This warranty includes sash and frame materials, hardware, and insulated glass units which under this warranty are warranted to be free of material obstruction of vision resulting from dust or film formation in the dead air space caused by failure of the seal.

This Warranty does not include and Harvey will not be responsible for:

  • Condensation on glass, which occurs as a natural result of humidity, excessive moisture, or changes in external temperatures, since these do not indicate a defect in the garden window product.
  • Normal maintenance including caulking to seal window frames or trim.
  • Labor or other costs incurred for removing, replacing, installing or reinstalling any defective window or part.
  • Damage or repairs required as a consequence of faulty installation, vandalism, misuse or abuse, normal weathering, atmospheric pollutants, harmful chemicals, fumes or vapors, fire, lightning, hurricanes, tornadoes, windstorms, ice, hail or other acts of God or conditions beyond HARVEY’s control, wind-borne objects, failure of the structure in which the window is installed, or failure to provide reasonable and necessary maintenance.
  • Garden window products installed outside of the continental United States, Alaska, Hawaii or Canada, or for industrial, commercial or business use.
  • Any special, indirect or consequential damages of any nature whatsoever. Some states do not allow the exclusion of incidental or consequential damages, so the above limitation may not apply to you.

LIMITATION OF WARRANTY

THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED OR ARISING BY OPERATION OF LAW OR OTHERWISE (INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) WHETHER OR NOT THE PURPOSE OR USE HAS BEEN DISCLOSED TO HARVEY IN SPECIFICATIONS, DRAWINGS OR OTHERWISE AND WHETHER OR NOT HARVEY’s PRODUCTS ARE SPECIFICALLY DESIGNED AND /OR MANUFACTURED BY HARVEY FOR BUYER’S USE OR PURPOSE .

This warranty does not extend to any losses or damages due to misuse, accident, abuse, neglect, normal wear and tear, negligence, unauthorized modification of alteration, use beyond rated capacity, or improper installation, maintenance or application. Buyer assumes all responsibility for design, application, installation, and use of the products manufactured by Harvey, and specifically, assumes responsibility for compliance with all applicable building and design codes relating to or involving the product.

The warranty granted by Harvey Industries, Inc. (DBA Harvey Building Products) is the Buyer’s sole and exclusive remedy for any claims covered by such warranty. Harvey shall not be liable in contract, in tort (including negligence or strict liability) or otherwise for damages to persons or property or equipment, loss of profits or revenue, loss of use of equipment, cost of capital, claims of customers of Buyer, or for any special, indirect, incidental or consequential damage whatsoever arising from or relating to the product. In no event shall the total cumulative liability of Harvey with respect to this contract, or anything done in connection therewith such as performance or breach thereof, or the manufacture, sale, delivery, resale or use of any product covered by or furnished under the contract, whether in contract, in tort (including negligence or strict liability) or otherwise, exceed the price of the product or part on which such liability is asserted or claimed.

Any advice furnished by Harvey with respect to the product is given without charge and without representation as to appropriateness; completeness or suitability of the product for any particular use or application and Harvey assumes no obligation or liability for any such advice given or results obtained. To the extent that Buyer has provided Harvey with any drawings, designs or specifications then Harvey’s sole obligation with respect to manufacture of any product is to do so in accordance with and to the specifications provided by Buyer on or with such drawings or designs and that Buyer shall be solely responsible for the suitability of such drawings, designs and specifications and for compliance with any and all applicable building codes and ordinances, and further agrees to indemnify, defend and save Harvey harmless from any loss, claim, damage, action or liability relating to or arising from same.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. These warranties may not be altered, enlarged or changed by any distributor, dealer or another person.

ProVia, LLC hereinafter “ProVia”, warrants to the original consumer purchaser, that under normal use this product will be free from defects in material and workmanship for as long as the purchaser owns and lives in the single family residence, hereinafter “Home”, in which the product was installed. The details of the warranty are as follows:

BASIC DOOR OR WINDOW – LIFETIME TRANSFERABLE

ProVia will replace under conditions of normal use, for as long as you own and live in the Home in which the product was originally installed, the “electrostatic” baked enamel paint finish if it is not free from flaking, checking, blistering, or peeling. This warranty is transferable to one subsequent purchaser.

INVENT™ RETRACTABLE SCREEN SYSTEM – LIFETIME

The InVent™ Retractable Screen System on the Spectrum™ Storm Doors is warranted against mechanical defects for as long as you own and live in the Home in which the product was installed.

SCREENS – LIFETIME / 15 YEAR

ProVia further warrants under conditions of normal use, the stainless steel DuraGuard screen against rotting, rusting, or separation for as long as you own and live in the Home in which the product was installed. Further, ProVia will replace under conditions of normal use, for a period of fifteen (15) years from the date of installation, the fiberglass, aluminum or SeeVue stainless steel screening if it is not free from rotting, staining, or rusting.

GLASS – LIFETIME

STORM DOORS & STORM WINDOWS

ProVia further warrants the glass units of its Aluminum Storm Doors and Storm Windows against breakage as follows: (1) If the glass in a properly registered and warranty covered unit breaks as the result of a manufacturing defect; (2) In the event of an accident in the Home that is not covered by insurance or is of an amount that is within the insurance policy deductible, ProVia will replace the glass free of charge, for as long as the original purchaser owns and lives in the Home in which it was originally installed.

STORM DOOR HANDLES / MAIL & MAGAZINE SLOTS – LIFETIME / 1 YEAR

ProVia further warrants all storm door handles, mail slots and magazine slots with a Bright Brass, Bright Brass Look, Satin Nickel or Aged Bronze finish against tarnishing for as long as you own and live in the Home in which the product was installed and against mechanical defects for a period of (1) year from date of installation.
ProVia further warrants all storm door mortise handles with an Antique Brass finish against tarnishing for a period of ten (10) years from date of installation and against mechanical defects for a period of (1) year from date of installation.

HARDWARE – 1 YEAR

ProVia further warrants to purchaser that it will replace, for a period of one (1) year from the date of installation, all other parts (including hardware) which are not the above-specified components if those parts are not free from defects in material and workmanship under conditions of normal use and wear. Tarnishing and fading are considered to be the products of normal use and wear. As a result, they are not covered under this warranty.

TRANSFERABLE WARRANTY

The Warranty on the basic window or storm door unit is transferable by the original purchaser to one subsequent purchaser for purchaser’s personal residence provided ProVia receives the Warranty Transfer Certificate within thirty (30) days after the date of transfer of ownership, and provided such notice is accompanied by a check or money order in the amount of $50.00 per home.

NON-RESIDENTIAL APPLICATIONS

Where the structure in which the product is installed is not a single family residence occupied by the purchaser, or is owned by a public or private corporation for profit or non-profit, an unincorporated association or other business entity of any type recognized by law, a church, a school, a governmental or public authority, the time periods stated in this warranty shall be limited as follows: Basic Door or Window – 5 Year (non-transferable); Storm Door Handles – 5 Year finish/90 Day mechanical; Screens – 5 Year; and Insulated Glass – 10 Year (glass breakage not included).

COASTAL APPLICATIONS

For products that are installed in a Coastal region the time periods stated in this warranty shall be limited as follows: InVent Screens – 5 Year; and Storm Door Handles & Mail/Magazine Slots with a Bright Brass, Brass Look, Satin Nickel or Aged Bronze finish – 5 Year Finish.

WARRANTY CONDITIONS

No warranty herein covers damages resulting from improper installation, abuse, negligence, abnormal or unreasonable use (including failure to provide reasonable and necessary maintenance), damage resulting from fire or lightning, windstorms, earthquakes, wind-borne objects, strain applied to the unit by movement of the building, inadequate provision for expansion or contraction of framing members, installation in ships or vehicles, installation outside the Continental United States, seal failure (if the seal has been subject to immersion in water), acts of God, or other causes beyond the control of ProVia.

Condensation on units may occur as the natural result of humidity within the house or building area. This natural result may come from changes in interior or exterior temperatures and does not indicate a defect in the unit. This warranty does not cover condensation, nor frost or freezing from condensation on the unit.

On some installations, caulking is used to seal the frames or trim packages against water or air penetration. Caulking is not considered a part of the window or door, and therefore, is not covered under this Warranty. Caulking is normally considered a maintenance responsibility of the purchaser.

The procedure for obtaining performance of the obligations of this warranty is as follows: if you believe your unit to be defective, contact the contractor for inspection. If the contractor determines the unit or parts thereof to be defective, the manufacturer at its exclusive option will repair, provide a new product or part of a product after having determined that it does not conform to the limited warranties contained herein. The manufacturer reserves the right to discontinue or make changes in any of its products. If the products covered by this warranty are not available, the manufacturer shall have the right to substitute a product that is of equal quality or value. The manufacturer will ship the replacement product or part to the nearest authorized dealer and the purchaser must pay for any and all labor necessary to install such product or part and for the transportation from the nearest authorized dealer to his/her residence.

For the first three (3) years after the date of installation, ProVia will offer to the original purchaser a credit toward installation of twenty-five dollars ($25) for any aluminum storm door unit which ProVia determines to be defective in materials or workmanship pursuant to the terms and conditions of this warranty. It will be the responsibility of the original owner to make arrangements for installation with the dealer.

The warranty on the replacement finish, components, or parts, will be limited to the balance of the time remaining on the warranty of the original finish, components, or parts as the case may be.

Any claim must be accompanied by a copy of the Warranty certificate and a copy of the contract evidencing purchase of the ProVia products.

PURCHASER’S EXCLUSIVE REMEDY SHALL BE THE REPLACEMENT OF DEFECTIVE FINISH, COMPONENTS, OR PARTS, ALL AS PROVIDED HEREIN. IN ANY EVENT, THE LIABILITY OF ProVia WITH RESPECT TO ANY CONTRACT, OR ANYTHING DONE IN CONNECTION THEREWITH SUCH AS THE PERFORMANCE OR BREACH THEREOF OR FROM THE MANUFACTURE, SALE, DELIVERY, RESALE, INSTALLATION OR TECHNICAL DIRECTION OF INSTALLATION, REPAIR OR USE OF ANY STORM DOOR, STORM WINDOW, REPLACEMENT WINDOW, COMPONENT OR PART COVERED BY OR FURNISHED UNDER THIS CONTRACT WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, OR OTHERWISE, SHALL NOT, EXCEPT AS EXPRESSLY PROVIDED HEREIN, EXCEED THE PRICE OF THE STORM DOOR, STORM WINDOW, REPLACEMENT WINDOW, PART OR COMPONENT ON WHICH SUCH LIABILITY IS BASED.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to purchaser.

THIS WRITING CONTAINS THE ENTIRE AGREEMENT BETWEEN ProVia AND PURCHASER. DEALERS, CONTRACTORS, APPLICATORS, OR DISTRIBUTORS OF ProVia PRODUCTS HAVE NO AUTHORITY TO GIVE WARRANTIES ON ProVia’S BEHALF, THAT ARE DIFFERENT FROM OR EXCEED THOSE LISTED HEREIN. PURCHASER SHOULD THEREFORE EXAMINE THIS LIMITED WARRANTY CAREFULLY.

ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE TERMS HEREOF.

This Lifetime Limited Transferable Warranty extends only to the original ProVia storm doors, storm windows and/or replacement windows which were originally installed in your Home or other structure as recorded on the warranty registration and shall not be valid or enforceable if you cannot prove that the storm doors, storm windows and/or replacement windows were so installed. To establish a record of your purchase please register your warranty online at www.provia.com/warranty.

Important Note: Failure to fill out the online warranty registration form will not affect your rights under the warranty if you can show the date of purchase and the location the storm doors, storm windows and/or replacement windows were installed in a reasonable way. (Your receipt of purchase and the receipt from the contractor who made the installation in your Home showing the address is one such way. Please keep them in a safe place.)

Aluminum members that have a baked enamel finish are warranted against blistering, peeling, flaking or checking under conditions of normal wear and service for a period of ten years.

The above warranty periods commence on the date of shipment from the manufacturing facility.

This warranty does not cover broken glass; torn screening; damages resulting from improper installation; damages caused by airborne pollutants such as salt or acid rain; negligence or unreasonable use (including failure to provide reasonable and necessary maintenance); stress resulting from localized application of heat that causes excessive temperature differential over the glass surface or the edges of the unit; damage resulting from fire, lightning, windstorms, earthquakes, windborne objects, strain applied to the unit by movement of the building or inadequate provision for expansion or contraction of framing members; condensation on windows, which is a natural result of humidity within the house and the difference between the internal and exterior temperatures; installation in ships, vehicles, or outside the continental United States; seal failure if the seal has been subject to immersion in water; acts of God or other causes beyond the control of the manufacturer.

The extruded, solid vinyl members are warranted against defects in material and workmanship for as long as the original purchaser owns and resides in the house in which they are installed.

TWENTY YEAR WARRANTY

Insulating glass is warranted against material obstruction of transparency resulting from film formation or dust collection on the interior surfaces for a period of twenty years.

TEN YEAR WARRANTY

TEN YEAR WARRANTY

Harvey Industries Inc. (“Harvey”, DBA Harvey Building Products) warrants that paint, factory-applied by Harvey Building Products on either Harvey vinyl window surfaces or Therma-Tru door surfaces, will be free from manufacturing defects which result in rotting, cracking, warping, pitting, corroding, peeling, blistering or non-uniform fading discoloration for a period of ten (10) years from the date of purchase.

This warranty covers only manufacturing defects in material and workmanship of the paint applied by Harvey Building Products on Harvey vinyl windows and Therma-Tru doors and without limitation, does not include any failure, defects or damages attributable to, or arising from or connected with harmful fumes, chemicals, distortion or warping due to building heat, heat build-up, excessive temperature exposure or unusual heat sources including outdoor grills, interior and exterior reflection from roofs, windows, walls, window coverings or other surfaces, color change arising due to normal weathering, oxidation, extremes of weather and atmospheric conditions, accident, abuse, misuse, neglect, faulty or improper installation, staining or mildew, fire, flood, earthquakes, hurricanes, tornadoes, cyclones, gales, lightning, hail and Acts of God, accidental or intentional damage, vandalism and all other circumstances and causes beyond Harvey’s control.

This warranty does not apply if the surfaces are painted or coated with any substance other than with coatings provided by and applied by Harvey Building Products. This warranty is non-transferable.

IMPORTANT:

Extrusions or surfaces which experience color change due to normal weathering are excluded from this warranty (including non-uniform fading and discoloration and color changes resulting from unequal exposure of surfaces to the sun and elements). “Normal Weathering” is defined as exposure to ultraviolet (sun) light, and extremes of temperature and atmosphere which will cause any surface to fade, discolor, darken, chalk, or acquire a surface accumulation of dirt or stains. The severity of these conditions depends on air quality, the geographic location of the finished products, and other local conditions over which Harvey has no control.

Any claim under this warranty must be submitted in writing promptly after discovery of the defect claimed, describing with reasonable specificity such defect. Claims relating to product defect shall be submitted to Harvey, who at its own discretion, shall determine whether a claim relating to the paint product is valid with reference to AAMA 615-02 standard. Any claim under this warranty will be subject to Harvey’s determination of validity and if Harvey determines the claim is valid, any such claim is expressly limited to providing paint of similar color. The original warranty period shall not be extended by any replacement, but the remaining warranty time period shall continue in effect and be applicable under the terms and conditions of this warranty to the painted surfaces. Harvey reserves the right to discontinue or change paint manufacturers. If the paint has been discontinued or is not available, Harvey reserves the right to substitute paint of similar quality and color as may be compatible.
